Most citizens go about their busines and never think about what goes on in the criminal justice system, that is, until they or someone else in their family gets caught up in the system. Take the case of Ricardo Rachell, the man that was released in Harris County after spending six years in prison for a crime he did not commit. He is one of the lucky ones because he had DNA that eventually freed him, but what about the ones that do not have DNA, but have othe evidence?
In the case of Ricardo Rachell, the evidence was in the Houston Police Department's property room. Why did the Harris County District Attorney's office not request this during the investigation of the case? Wouldn't it have been common sense to do so? When interviewing the prosecutor who prosecuted the case, he stated it wasn't his fault, he inherited the case? Does not the same level of responsibility follow when cases are passed, or do they just assume and expect others to have done a competent job?
I was in the criminal justice at one time and chose to get out because I saw people in positions of authority do things, and then the administration back them up, that I knew for a fact was wrong. When I would report it, the person(s) would retaliate and the administration would back them up. This appears to be how the Harris County District Attorney's office is run also.
During the time all the candidates were campaigning for the Harris County District Attorney seat, I was very skeptical, and with good reason. After my experiences with the Texas Department of Corrections, I believe things when I see them. One candidate in particular ran her campaign on "change", stating that "sunshine is the best disinfectant" and "justice for all isn't just a phrase". I was told by everyone, she would be the person who would stand by her "word".
I was told, as I grew up, that a person's worth is based on the value of their "word" and have stood by this all my life, but have found out throughout my life that people do not have the same. I say this because I have written to that same person who made the above statements throughout her campaign. Yes, the person who won her seat based on her "word" of promoting fairness in justice if she took office.
The last time I wrote Pat Lykos, the new Harris County District Attorney, I sent over a package with evidence outlined that proved that the prosecutor that prosecuted my brother, had prosecuted him on nothing but perjured evidence. That is because I had written her three times previous requesing a meeting and never received a response, so I decided that Iwould send it to her and trying to hold to the believe that she would actually take the time to review the evidence tha proves the state's witnesses committed aggravated perjury with the intent of getting my brother prosecuted. To date, I have never received a response.
This proves that she, or any of those people in which the evidence has been given, gives a crap about "justice". They would rather keep the case closed, than to see an innocent man relieved of the buden of living with a conviction for a crime he did not commit. They would not feel that way if it was them or a member of their family. As far as I am concerned, they have committed a crime more severe than their star witnesses, they have committed a crime against humanity, to deprive someone of their right to freedom and equal protection under the law. In my book, that makes them all hypocrits. To stand up and put their hand on a bible and swear to protect everyone equally and uphold the Constitution and the laws of the State of Texas.
